Terms of Service

• You must be at least 18 years old, or an authorised representative of a registered educational institution, to create an account.
• You are responsible for the accuracy of registration information and for all activity that occurs under your account.
• You must keep credentials confidential and notify us promptly of any unauthorised use.
• Accounts created for an institution may have multiple users with different roles; the institution remains responsible for managing those users.

SchoolDesk is offered on a subscription basis. Features, limits (e.g. number of students, campuses, SMS credits), and pricing depend on the plan you select. We may offer free trials or demos at our discretion; trial terms will be communicated at sign-up. We may modify plans, features, and pricing with reasonable prior notice.

• Fees are payable in advance for the subscription period chosen (monthly, quarterly, or annually).
• Subscriptions renew automatically unless cancelled before the renewal date.
• Late payments may result in suspension of access until outstanding amounts are cleared.
• Except where required by law, fees are non-refundable. Pro-rated refunds may be granted at our sole discretion in exceptional circumstances.
• Add-on services such as SMS bundles, WhatsApp messaging, custom development, or training are billed separately.

You retain all rights to the data your institution uploads to SchoolDesk ("Customer Data"). You grant SchoolDesk a limited licence to host, process, transmit, and display Customer Data solely to provide and improve the Service. You are responsible for the lawfulness, accuracy, and quality of Customer Data and for obtaining any necessary consents from staff, students, and parents.

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Upload viruses, malware, or any code designed to disrupt the Service.
• Attempt to gain unauthorised access to other accounts, systems, or networks.
• Reverse engineer, decompile, or copy the Service or its underlying technology.
• Resell, sublicense, or white-label the Service without prior written permission.
• Send spam, unsolicited messages, or content that violates third-party rights.

We may suspend or terminate accounts that violate these rules.

The Service, including all software, design, text, graphics, logos, and trademarks, is owned by SchoolDesk and Elevortech and protected by intellectual property laws. Nothing in these Terms transfers ownership of our intellectual property to you. Feedback you provide may be used by us without restriction or compensation.

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, upgrades, or factors beyond our reasonable control. We will make commercially reasonable efforts to notify customers of planned downtime.

The Service may integrate with third-party tools (payment gateways, SMS providers, WhatsApp Business APIs, email services). Your use of those services is subject to the third party's terms. We are not responsible for the availability, accuracy, or content of third-party services.

The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or meet every specific requirement of your institution.

To the maximum extent permitted by law, SchoolDesk and Elevortech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total cumulative liability arising out of or related to these Terms shall not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless SchoolDesk, Elevortech, and their officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your Customer Data, or your violation of these Terms.

• You may cancel your subscription at any time from your account settings or by contacting support.
• We may suspend or terminate access for non-payment, violation of these Terms, or risk to the security of the Service.
• Upon termination, your right to use the Service ends immediately. We will make Customer Data available for export for a reasonable period before deletion, unless prohibited by law.

We may update these Terms from time to time. Material changes will be announced through the Service or via email. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts located in Pakistan.
